Please read these terms carefully before booking a session or making use of our services. By engaging with Continuum Visual Studio you agree to the terms outlined below.

01 — Agreement

Acceptance of Terms

These Terms and Conditions ("Terms") govern the relationship between Continuum Visual Studio ("we", "us", "our") and any client or individual ("you") who books a session, requests a quote, or makes use of our photography or videography services.

By confirming a booking, making a deposit payment, or communicating your intent to proceed with a session, you acknowledge that you have read, understood, and agree to be bound by these Terms.

We reserve the right to update these Terms at any time. The current version will always be available on our website.

02 — Bookings

Booking & Confirmation

All bookings are subject to availability and are only confirmed once a non-refundable deposit has been received. Until the deposit is paid, your session date is not reserved.

  • A deposit of 50% of the total session fee is required to secure your booking
  • The remaining balance is due on or before the day of the session
  • Bookings made with less than 48 hours' notice are subject to full upfront payment
  • We reserve the right to decline any booking at our discretion

All booking enquiries and confirmations are handled via WhatsApp or email. Please retain all correspondence as proof of your booking details.

03 — Cancellations

Cancellations & Rescheduling

We understand that circumstances change. Please notify us as early as possible if you need to cancel or reschedule your session.

  • Cancellations made more than 7 days before the session date: deposit may be transferred to a rescheduled date (once only)
  • Cancellations made within 7 days of the session date: the deposit is forfeited
  • Cancellations on the day of the session or no-shows: the full session fee is payable
  • Rescheduling is permitted once per booking, subject to availability, with at least 48 hours' notice

In the event that we need to cancel or reschedule due to unforeseen circumstances on our side, we will notify you as soon as possible and offer an alternative date or a full refund of your deposit.

04 — Delivery

Image & Video Delivery

Edited photographs and video content will be delivered within the timeframe communicated at the time of booking. Standard turnaround times are as follows:

  • Photography sessions: 7 to 14 business days after the session date
  • Videography projects: 14 to 21 business days after the shoot date
  • Rush delivery may be available at an additional cost — please enquire before booking

Final deliverables are shared via a private online gallery or download link. It is your responsibility to download and back up your files within the period specified. We cannot guarantee indefinite storage of your files after delivery.

The number of edited images or the final video duration will be as agreed upon at the time of booking. We do not provide unedited raw files.

05 — Copyright

Ownership & Usage Rights

All photographs and video content created by Continuum Visual Studio remain the intellectual property of Continuum Visual Studio. Upon full payment, you are granted a personal, non-exclusive licence to use the images for personal purposes.

  • Personal use includes printing, sharing on personal social media, and keeping for your own records
  • Commercial use of any content (advertising, resale, publication) requires a separate written agreement and may be subject to additional fees
  • You may not alter, crop, filter, or manipulate delivered images in a way that misrepresents the original work
  • Credit to Continuum Visual Studio is appreciated when sharing on social media

We retain the right to use all photographs and video content for portfolio, website, and social media marketing purposes. If you prefer your images to remain private, please inform us in writing before your session and we will honour that request.

06 — Conduct

Session Conduct & Responsibilities

To ensure your session runs smoothly and we can produce the best possible results, we ask that all clients observe the following:

  • Arrive on time — late arrivals may result in a shortened session with no reduction in fees
  • Communicate any special requirements, health considerations, or accessibility needs in advance
  • Ensure all participants (including minors) have the necessary consent to be photographed or filmed
  • Treat our equipment, studio space, and team with respect — any damage to equipment caused by a client may be charged accordingly

We reserve the right to pause or terminate a session if the conduct of a client or their guests is deemed disrespectful, unsafe, or disruptive. In such cases, no refund will be issued.

07 — Liability

Limitation of Liability

Continuum Visual Studio will take every reasonable measure to deliver high-quality work. However, in the unlikely event of equipment failure, data corruption, theft, or other circumstances beyond our control, our liability is limited to a refund of fees paid for the affected service.

We are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services, including but not limited to loss of personal or commercial opportunities.

Clients attend sessions and allow minors to participate entirely at their own risk. Continuum Visual Studio accepts no liability for injury or loss sustained during a session.

08 — Governing Law

Jurisdiction & Disputes

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of our services will be subject to the jurisdiction of the South African courts.

We encourage clients to contact us directly in the first instance to resolve any concerns informally. We are committed to fair and respectful engagement with all our clients.

These Terms were last updated in 2025 and may be revised from time to time. Any updates will be reflected on this page.
